   First I would like to say for the most part much of the info I read on here is fairly accurate. However I thought about responding to a few posts only to see there is so much BS being spread about scooters on here that it would be a continuos uphill battle at least to clarify the erroneous rhetoric being portrayed as fact here.

I even read where someone said BOSS Scooters were made in NM. As the former owner of BOSS Powersports I can assure you that they are not made in NM or in the US for that matter.

I also read that ROKETA scooters are illegal. I find that amusing to say the least.

   If the rebranders or Chinese scooters want to be taken seriously, they should post links to their EPA, DOT, and CARB legality. And while you could say that Kymco, Vespa and others don't do that, they have the credibility that comes with nation wide dealer networks. There are a lot of companies claiming to be approved by those agencies, but never back it up.

   First ROKETA is 6 months old and we are building our dealer network now. Anyone who actually needs our EPA certs is welcome to request them.

When Vento started in 96 they were in the same boat most companies are when they first start out. They buy there engines from a company who has EPA approval and put them in their scooters. We are doing the same until we get our own EPA certs. Right now we have purchased engines from 2 different suppliers but both made in the same factory. The certs are for Chuanl right now as we are using their engines.
Cert # Chuanl-mc-2005-01
Engine family is 5CHMCO.15NFG

We are testing 3 engines right now and these will be ready in about 45-60 days for our 06 lines.

Search for Goldenvale on the CARB site until the ROKETA certs come in.

I am in 100% agreement with you on many of the Chinese companies who do not do things on the "Up & Up". I, of course, have to take offense when we are thrown into the same category.

We are not Vento, Kymco or Vespa...... Yet.
I personally own a Kymco ATV (250 Mongoose). Awesome ATV for the money.

We are growing and learning and I will learn from you guys as well as share my knowledge. All I ask that before you post something as fact, about my company, you also need to "Back it up".

   Under "Manufacturer name" put ROKETA. Make sure you spell it correctly.

Or under WMI put 5RY

I'll tell you what I find amusing - the following contract clause on your web page. "Purchaser hereby agree to release and forever discharge Goldenvale Inc. and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf, from any and all claims, actions, damages, liability, costs or expenses and attorney fees which are related to, arise out of, or are in any way connected to the participation or use of the equipment or property supplied by Goldenvale Inc. or my presence upon the premises, whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of the seller lor the manufacturer or distributor. By this Agreement, it is my intention to surrender and waive any rights to sue or exercise any legal right to seek damages from Goldenvale Inc. and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf."

One bit in particular amuses me "whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of the seller lor the manufacturer or distributor."

Very funny. Who is the lawyer that wrote this for you? I think you should fire them, and I'm not suggesting it because of the spelling error.

   Basically that is a standard clause in most franchise agreements. It helps protect us from those who like to sue when they screw up. Kinda like the lady who sued McDonalds for spilling a cup of coffee on herself. She claimed the coffee was too hot. In other words after the bikes leave here we have very little control over how they are used. If the seller is negligent then the person should sue the seller, not us. If we are negligent then of course they can sue us.

Of course anyone can sue anyone for damn near any reason. I am just the messenger and will relay this back to the powers that be.

   Its not a standard clause in motor vehicle franchise agreements. Motor vehicle franchise has a different set of laws, pertaining specifically to motor vehicles.

Extra protections are built in for the dealer, mainly at state level, in relation to PLI, and liability for negligence. This also holds true for many other non-motor vehicle products.

A basic rule of thumb is that you can't waive liability for property or personal injury damage.

As a dealer I find it amusing that you say you are trying to build a dealer network, but seem very hurried to push all liability off onto the dealer. Reading that clause makes me want to run a mile.

Here's a link from Entrepeneur that relates to any product, but MV law is generally tougher than general products, like a cup of coffee or a PC. Its basic, but covers the gist.

   Yes we carry 5,000,000 in product liability insurance.

I will look into the statement and why it is on the web site. I agree from a dealers stand point it does not look good. Basically I am being told it is a indemnification statement in case some dealer or distributor allows a person to ride a product on a franchised dealers property or under the supervision of a dealer.

Maybe it should be more clear. We are not trying to puch liability off to the dealer. We are simply making it clear that we are not responsible for the actions of those who are not under our direct control. Anyone who thinks otherwise is simply not educated in this area and I am not claiming I am.

My expertise is in the product and other areas and I will try and limit my responces to those areas.

   As administrator of this website I extent the same opportunities to you that I have to all others in the chinese scooter import community.

I will gladly come inspect your products and contact my governmental sources to validate any claims of compliance.

If everything checks out, then I will make a big point of informing the bbs users of the facts.

Similarly, if they do not check out, then I will pass on that information as well.

As an informational website it is in the interest of all that the real information be known and that proper credit be given when deserved.

I respect all companies that are compliant with US statutory requirements and I wish to honor those that make the effort.

   I applaud your efforts. I also understand your position. I have ran several BBS's myself over the years and I know what you go through. One case in point www.bladeforums.com with the following stats: Threads: 218,112, Posts: 2,263,520, Members: 35,037

A quick search in Google for my name alone will yield results showing I have "been there, done that".

Those who know me know I shoot from the hip and tell it like it is. I was a distributor before being a manufacturer and I have been through nearly every aspect of this business. I am the one who deals with EPA, CARB and DOT not too mention Catarc, SAE, CPSC and all EWR reporting.

I also will not spam this forum as I have seen others do. I will be in China from October 12th through the 24 and I will visit 12 factories, many of which have been mentioned here on this board. I have been to many of these factories and I know who makes crap and who makes good stuff. Anyone here is welcome to visit our warehouse in Ontario California. For a comparison you can place Tank's warehouse inside ours over 20 times. We are not small and we are not a fly by night.

If I can be of assistance let me know. I no longer have the time to surf these boards but I will answer when I can. I came on here because a dealer told me that there was a lot of mis-information going on about our product.

Those of you who post here and make claims that certain products are not legal should back up your claims. Saying a Tank scooter is not legal is not correct. Saying it is not legal for street use in California because of CARB is closer to the truth. The bad thing is too many dealers out there are not licensed and this gives our whole industry a bad rap. Also I have been here for about 9 months now. I have done a lot of work but a lot remains to be done.

One thing to think about seriously is how far China's quality has come in just the last 2 years. Imagine where it will be in 2 more years! ROKETA will be at the front of this group along with others that may live through the huge shakeout which is about to occur on January 1st.

Do I read correctly from your web site that you offer a 30 day parts only warranty on your scooters?

Chinese manufacturers have been making scooters for much longer than this not to mention most of the technology is old and out of contract. The Gy6 engine is not exactly revolutionary. Also you stated you are testing 2 "new" engines for your 06 lineup due in 45 days? Isn't that how long it takes a boat to get across the sea?

Whats happening January 1st?

Lastly while I really would like to see you do well I think your warranty needs review!

The warranty is now 6 months on all internal lubricated parts and 30 days on all others that are covered.

"Right now we are finalizing our purchase of 2 factories in China. Here is the warranty as it stands right now."

This is a bold move, most 'importers' simply use the factories certification as you stated if this is true I really do hope you make it as this is a HUGE move.

Our new web site will replace the existing one in a few weeks and will reflect many changes.

Right now we are finalizing our purchase of 2 factories in China. Here is the warranty as it stands right now.

If your VIN starts with A1Z, 5RY, LJ4, LF3 or LFG you now have our 6 month warranty.

All other VINs are 30 days.

I'm pleased that you are representing Roketa scooters. We all consider it a sign of respect. My advice: run. Never post here - just monitor it. You are asking for trouble. Some jerk like me is bound to get you stumbling eventually.

Roketa scooters - the ones I have seen and ridden - are pretty much crap in my opinion. They are no better or no worse than any other "brand" of chinese shite bikes. (I include Tn'G in this category).

The quality of the scooters themselves, however, is often secondary to the importance of how the scooters are sold and distributed. Roketas are all over the web and on E-Bay. This is a sign of a poorly supported product.

If you (like Baron) want to get serious about all of this and act like big kids you need to reel in the network and work only through credible shops with local service.

Naturally, as with most things, the wrong way is substantially easier than the right way. Selling scooters through dealerships requires more sales and development than most Chinese scooter merchants choose to invest. National sales mangers (like you) need regionals and regionals need dealers.

   As a owner of a Roketa product I can say that Goldenvale Inc. & Roketa products sucks. Poor Quality product and no parts....
